Shortly after 1:30 in the morning on Monday, July 22, 2024, Officer Emma Dostalek was parked on North Lake Drive in Whitefish Bay when a white BMW SUV went past her squad — honking as it went. Her radar read 60 mph in a 30 mph zone, and she pulled the BMW over in the 4600 block.
The driver, Mallory P. Griffin, 35, of Illinois, did not stay stopped. The BMW accelerated away from the stop, then braked and stopped abruptly — the first of two flights that night. With the BMW stopped again, Officer Dostalek ran the encounter as a high-risk stop from behind her squad's public-address system, ordering Griffin to turn the car off and come out. Griffin stayed behind the wheel, and Sergeant Daniel Rossmann's report describes her throwing an object from the window and gesturing at the officer while the PA commands continued.
Anticipating a second run, Sergeant Rossmann set up south of the stop at East Glendale Avenue with stop sticks, positioned behind a tree on the parkway, and Shorewood police were called in as mutual aid. When the BMW fled the second time and came south toward Glendale, it swerved around the stop sticks — passing within an inch of them and coming dangerously close to the sergeant's position — before stopping. Officers then took Griffin out of the vehicle at gunpoint and into custody.
At the station: the tests
Griffin was taken to the Whitefish Bay station. She refused or could not complete most of the standardized field sobriety tests. Then came the result that reframed the whole stop: her breath test read .000 — no alcohol measured at all.
Griffin refused a blood draw, so officers obtained a search warrant (Milwaukee County warrant 24SW2934) and her blood was drawn under it. The sample went to the Wisconsin State Laboratory of Hygiene. On August 13, 2024, the lab's ethanol result came back: Not Detected. The report lists the drug screening as pending at the time it was written.
